Court Management

A court chairman is elected in order to manage the work of the court and to fulfil other tasks stipulated in the court rules.

The court chairman is chosen from minimum three candidates in elections held between isePankur users. The candidates must have the required knowledge (higher education in law), experience and good reputation in order to fulfil the court chairman’s role. Only candidates who have provided a written approval to take up the court chairman role in case they win the elections can be put forward for candidacy. The candidate can be a user at isePankur, however not a person associated with Sõbralaen OÜ.

Participation at the elections (putting forward candidates and voting) is open to the following users:

  1. who have been registered users for minimum 3 months;
  2. who do not have any unsettled debts;
  3. who have invested minimum 640 EUR or paid back minimum of 320 EUR of principal.


Each user has one vote at the elections. The court chairman is chosen based on majority vote, however a minimum of 25 votes must be gathered. A second voting round is held in case the candidate with the most votes does not have 25 votes. Two of the candidates with the most votes will participate in the second round. The candidate with the most votes, regardless of the number, will win the second round.

A court with up to three judges is made up according to the court rules in order to solve each dispute. One of the three judges is always the court chairman, who chairs the court, one judge is chosen from the borrowers and one from the investors. The judge from the borrowers and investors is chosen separately for each dispute. The judges are chosen from the users who have agreed to participate in the court proceedings as a judge based on a random choice process.

The judge cannot be a party of the dispute. The judge must be objective, independent and impartial. The powers of the chosen judges are valid until the end of the dispute proceedings or until the powers of the judge are revoked. The remuneration principles for the judges are set by Sõbralaen OÜ management.
